Terms of Service for Lead Capture, Designer & Proposals

1. Introduction

Welcome to Aerialytic (“we”, “us”, “our”). By signing up for our SaaS software web application Lead Capture, Designer and Proposals, you (“customer”, “you”, “your”) agree to be bound by these Terms of Service (“Agreement”).

2. Services Provided

Aerialytic’s Lead Capture, Designer & Proposal web application provides an instant AI solar design tool and sales proposals that can be used to assist you with generating a preliminary solar design, creating and editing a complete solar design and creating solar sales proposals. It also enables you to re-activate residential solar leads by generating and sending them a preliminary solar design and / or proposal.

3. Term and Renewal

This Agreement shall commence on the date of your subscription and remain in effect indefinitely, unless you decide to cancel your subscription. The subscription will automatically renew every 30 days unless either party provides written notice of non-renewal.

4. Cancellation Policy

Aerialytic allows customers to cancel their subscription at any time. Cancellation requests will take effect at the end of the then-current subscription period in which the cancellation request is made. Customers will be responsible for all subscription fees, applicable taxes, and other charges incurred up to the cancellation date.

Aerialytic does not offer partial refunds for cancellations made mid-cycle.

5. Billing and Payment

You will be billed on a monthly basis in accordance with the design tier you decided to purchase with us during sign-up. Monthly subscriptions will be billed on the same day each month.

All monthly subscription fees are billed in U.S. dollars and are charged at the start of each subscription period.

Payment must be made using a valid credit card or other accepted payment methods as specified in the payment link we send you. Until such time that you cancel your subscription you will be billed on a monthly basis whether you use the software or not.

6. Design Roll Overs

Your monthly subscription includes a design package with a set number of monthly designs. These designs expire every 30 days and cannot be rolled over whether you use them or not.

7. Single Company Use

Our software license is intended for use by one company only. You are not permitted to use our software for multiple companies under a single license. Each company must have its own separate license.

8. User Responsibilities

You agree to use our software in compliance with all applicable laws and regulations. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

9. Modifications to Service and Agreement

We reserve the right to modify or discontinue the service at any time, with or without notice. We may also update this Agreement from time to time. Your continued use of the service after any changes to this Agreement will constitute your acceptance of such changes.

10. Limitation of Liability

To the maximum extent permitted by law, Aerialytic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.
